Many employers go beyond compliance by implementing diversity and inclusion (D&I) programs that take race, gender, and other demographic characteristics into account. When these programs are carefully designed and implemented, they can help reduce an employer’s exposure to individual and systemic discrimination risks. When they are not so carefully designed, these programs can have the opposite effect, increasing the employer’s exposure to workplace discrimination liability.
