On the state and local level, recent developments include:

  • Ban-the-Box — Wisconsin’s Supreme Court ruled that an employer cannot discharge an employee based on a non-criminal citation.
  • Paid Leave — Maine employers must register through the Paid Leave Portal. Maryland postponed its Family And Medical Leave Insurance program. Missouri’s paid sick leave law took effect May 1. Employers can access a model notice on the state’s website.
  • Pay Frequency — New York state amended its pay frequency law to limit liquidated damages for a first offense.
  • Protected Classes — A federal court ruled that Minnesota’s Human Rights Act does not protect a remote worker who is not in Minnesota.
  • Non-competes and non-solicitations — Kansas clarified when a non-solicitation agreement is enforceable. Virginia forbade non-compete agreements for employees who are non-exempt under the Fair Labor Standards Act. Wyoming banned most non-compete agreements starting July 1.
  • Posters — Ohio will allow employers to post some labor law notices online.
  • Sex/Gender — A new Wyoming statute defines “male” and “female” based on biological sex at birth.
  • Wages/Commissions — New Jersey’s Supreme Court ruled that commissions are “wages” under the state’s Wage Payment Law.
