The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) recently posted an Indian and Native American Employment Rights link on its website reminding federal contractors of a legal preference that exists for American Indians, and also discussing the “Indian and Native American Employment Rights Program,” which focuses on employment issues unique to American Indians and Alaska Natives.

We thought OFCCP’s notice provided a good opportunity to explain this exception in the law that allows employers to extend a preference to Native Americans in connection with employment opportunities on or near an Indian reservation. The preference is codified in Title VII of the Civil Rights Act of 1964, and also has been incorporated into OFCCP’s regulations.
