The Colorado Department of Labor and Employment (CDLE) has published an “Interpretive Notice and Formal Opinion,” or “INFO,” providing additional guidance on the state’s controversial Equal Pay for Equal Work Act (EPFEWA) that went into effect on January 1, 2021. The EPFEWA, among other things, requires a covered employer, defined as any employer employing at least one person in the state, to post for any Colorado employees all opportunities for promotions along with compensation information.

While the INFO provides some helpful clarifications and examples regarding covered employers’ responsibilities under the law and its Equal Pay Transparency Final Rules, it also reinforces some of an employer’s most burdensome compliance obligations.
