The State of Texas has filed a lawsuit in federal court seeking to block and invalidate new guidance recently issued by the Equal Employment Opportunity Commission (EEOC) entitled Protections Against Employment Discrimination Based on Sexual Orientation or Gender Identity. The lawsuit, filed in the Northern District of Texas, Amarillo Division, claims that the agency’s guidance on employer policies related to bathroom usage, dress codes, and pronoun usage is a substantive rule and was issued in violation of applicable procedural requirements.
