The Colorado Department of Labor and Employment (CDLE) has issued its Equal Pay Transparency final rules interpreting provisions of the Colorado Equal Pay for Equal Work Act, which goes into effect on January 1, 2021. While the final rules make significant changes to the rules proposed by the CDLE this past September, including important geographic limitations, the rules still place a significant burden on covered employers.

Given the broad scope of both the Colorado Equal Pay for Equal Work Act and the CDLE final rules, and the fact that they might serve as a model for other states to follow, we thought it would be helpful to provide the following analysis.
