Enforcement statistics covering fiscal year (FY) 2020 recently published by the U.S. Department of Labor’s Veterans’ Employment and Training Service (DOL-VETS) reveal that the number of complaints filed with the agency by military service members under the Uniformed Services Employment and Reemployment Rights Act (USERRA) declined only marginally from the previous year – 944 compared to 950 – and were in range with the average number of USERRA complaints filed each year over the last five years. In addition, DOL-VETS reports that it resolved 1,075 USERRA complaints in FY 2020, a 14% increase above the 940 complaints resolved in FY 2019 and above the most recent five-year average.
As in previous years, approximately 60% of the complaints resolved were categorized as either “no merit” or “complaint withdrawn.”
