In anticipation of the launch of the upcoming filing season for “Component 1” 2021 Employer Information (EEO-1) Reports, the Equal Employment Opportunity Commission (EEOC) has provided another update on its EEO-1 website. This most recent update adds a Fact Sheet and Frequently Asked Questions (FAQs) that address the filing responsibilities of third-party human resources organizations and their “client employers.” According to the EEOC, “the updated procedures are being implemented as part of the EEOC’s continuing efforts to modernize the agency’s EEO data collections and improve the quality of data collected.”
The new fact sheet clarifies that a client employer on whose behalf a Professional Employer Organization (PEO), Administrative Services Organization (ASO), or Human Resource Outsourcing organization (HRO) files its EEO-1s must have its own registration under the company’s EIN, as well as an individual-level user account to gain access to the EEO-1 Component 1 Online Filing System. In addition, the fact sheet clarifies that a third-party human resource organization is not permitted to certify a client employer’s EEO-1 Component 1 Report.
