According to newly available statistics recently obtained from the Administrative Office of the U.S. Courts (AO), the number of employment-related lawsuits filed in federal court during fiscal year (FY) 20191 decreased by 3.7% compared to the previous year, the lowest number recorded in more than a decade. In contrast, the overall number of civil lawsuits filed in federal court in FY 2019 – which include personal injury actions, contract disputes, and antitrust claims – increased by 5.3%, the highest number recorded in the past 20 years.
Percentage-wise, employment-related lawsuits filed in FY 2019 made up only 9.9% of all civil actions filed, the lowest percentage recorded since before 2000. In fact, except for lawsuits filed under the Family and Medical Leave Act (FMLA), all employment-related categories showed a decrease in the number of lawsuits filed for the year.
