National Labor Relations Board (NLRB or Board) General Counsel (GC) Jennifer Abruzzo recently provided additional insight with respect to her efforts to change U.S. labor law precedent to better fit her vision of a more union-friendly workplace environment. Ms. Abruzzo, a former union attorney, has made clear since the Senate confirmed her nomination by President Biden to serve as the NLRB’s chief lawyer that she believes the Trump-era NLRB skewed labor law precedent in management’s favor and that the law needs to be “rebalanced” to better protect employees’ right to organize. Her views are important because as the Board’s General Counsel, Ms. Abruzzo has unreviewable discretion to decide which alleged labor law violations will be prosecuted.
