We are pleased to offer the third in our series of memos analyzing the Supply and Service Contractors Technical Assistance Guide (TAG) issued by the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) last year. As was the case with our previous two memos, we focus here on distinguishing between OFCCP requirements and what might be better characterized as the TAG’s “best practices” that are often encouraged, but are not mandated under OFCCP’s regulations.

This memo looks specifically at the acceptable equal opportunity (EO) tagline options that contractors can use in their published job advertisements to demonstrate to applicants and job seekers that they are an equal opportunity employer under the three laws OFCCP enforces – Executive Order (E.O.) 11246, Section 503 of the Rehabilitation Act of 1973 (Section 503), and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA).
