As of this writing, there are 33 states and the District of Columbia that now have laws permitting the use of medical marijuana, and 10 states plus the District of Columbia that have laws legalizing marijuana for recreational purposes. This compares to 13 and 0 states, respectively, just ten years ago. Moreover, 13 of the states with medical marijuana laws explicitly prohibit employment discrimination based on an individual’s participation in a state medical marijuana program.

This growing patchwork of state laws has made it increasingly more challenging for many employers to enforce drug-free workplace policies without running afoul of state laws related to marijuana use.
