Starting on March 31, 2021, and annually thereafter, private employers with 100 or more employees and with at least one employee working in the state of California must report to the state’s Department of Fair Employment and Housing (DFEH) certain pay and hours worked data by race, ethnicity, sex, and EEO-1 job category for: (1) all employees working within California, and (2) employees working outside California, but assigned to a California location.

As the initial March 31 reporting deadline draws nearer, DFEH has been dribbling out information about these new pay reporting requirements and has posted it on a dedicated web landing page at California Pay Data Reporting. Included among these resources are Frequently Asked Questions (FAQs), the online Pay Reporting Portal and accompanying User Guide, and Data Specification Templates to be used for each submission.

While these resources help to answer some of the questions that have been raised about the new reporting requirements, there are still a number of practical questions that remain unanswered.
