The Department of Labor’s Veterans’ Employment and Training Service (DOL-VETS) has increased the contract dollar threshold under which federal contractors are required to file the annual VETS-4212 report from $100,000 to $150,000, effective on October 1, 2015.  Under DOL-VETS reporting requirements, federal contractors are required to file the VETS-4212 if the company held a qualifying contract in the prior calendar year.  Thus, depending on the timing of a qualifying contract, a company might not have to file a VETS-4212 for the 2016 filing cycle.

The contract threshold adjustment for filing the VETS-4212 now aligns this requirement with the contract value threshold triggering the obligation to prepare affirmative action plans (AAPs) for protected veterans under regulations enforced by the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP).  The contract threshold for veteran AAPs was adjusted last year from $100,000 to $150,000.

A notice announcing the new VETS-4212 threshold has been posted on the DOL-VETS website.  Please note that the information posted on the DOL-VETS website regarding the change in the reporting threshold is potentially misleading.  The notice simply states that “the” filing threshold for the 2016 filing cycle is $150,000.  However, there are two contract thresholds that determine whether a company must file in 2016, depending on the timing of contracts held in calendar year 2015.
