We have recently become aware that a number of employers have been told by their HR information systems vendors that covered federal contractors soon will no longer be required to use Form CC-305 – the unpopular disability self-identification form that contractors must use under Office of Federal Contract Compliance Programs (OFCCP) regulations – when inviting applicants or employees to disclose their disability status. According to OFCCP, this information is incorrect.

NT Lakis lawyers have spoken directly with a high-level OFCCP official, who has confirmed that the agency has no plans to abandon any aspect of the disability self-ID requirements for federal contractors. Further, the agency has no plans to even consider changing the disability self-ID form requirement.

The official with whom we spoke also provided us with some additional guidance regarding OFCCP’s requirements for online versions of the Form CC-305. In short, the agency intends to be a little more flexible in allowing contractors to integrate formatting changes to the form that are consistent with the company’s other online materials.
