As NT Lakis recently reported, the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has published its fiscal year 2019 Corporate Scheduling Announcement List (CSAL), which among other things identifies 500 establishments targeted for a “Compliance Check.” On May 8, 2019, OFCCP announced that it has now launched a “landing page” to help contractors prepare for compliance checks.
With the landing page now active, OFCCP will begin mailing compliance check scheduling letters at any time. Indeed, we have heard from some employers that they have received courtesy calls from OFCCP compliance officers advising them of the impending compliance check scheduling letters.
The landing page provides answers to four Frequently Asked Questions (FAQs). While most of the FAQs do not contain new information, and are in line with what we discussed in a previous memorandum on compliance checks, the FAQs do make clear that the agency will expect to receive an assessment of external outreach and recruitment efforts under Section 503 of the Rehabilitation Act (Section 503) and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).
