As part of the Trump Administration’s ongoing focus on regulatory reform, and as we reported previously, last fall the President signed an Executive Order (E.O.) requiring most federal agencies to establish a searchable, indexed database accessible to the public that contains or links to all “guidance” documents that are in effect from that agency. The E.O. was followed by internal instructions from the White House Office of Management and Budget (OMB) to each of the agencies on what should be posted, with a compliance deadline of February 28, 2020.
Among the covered federal workplace agencies, both the Equal Employment Opportunity Commission (EEOC) and the U.S. Department of Labor (DOL) have launched their online guidance portals at https://www1.eeoc.gov/guidance and https://www.dol.gov/guidance respectively. The EEOC portal lists 179 active guidance documents, while the DOL portal includes more than 7,500 guidance documents, with more to be added as the agency continues to identify those that should be included.
