We are pleased to present Part II of our two-part memorandum that provides guidance on preparing an effective employer position statement to present to the Equal Employment Opportunity Commission (EEOC) in conjunction with a discrimination charge investigation.

In Part I, we presented an overview of the current EEOC charge investigation process, including how it’s been largely digitized over the last few years, and described the five common stages of a charge investigation.

In this Part II, we zero in on the employer’s position statement itself, focusing in particular on considerations to keep in mind before drafting the statement; step-by-step suggestions for drafting the statement; and best practices to consider when drafting the statement that have proven effective over time.
