As anticipated, the Equal Employment Opportunity Commission (EEOC) this week updated its Employer Information (EEO-1) Report online filing portal to allow EEO-1 filers to begin using the “data file upload” filing method for submitting their completed 2019 and 2020 reports. This is the preferred method of filing for most major employers.
Despite initial indications from the EEOC that the file upload specifications for the 2019 and 2020 EEO-1 data collection would be the same as in 2018, however, the new file specifications contain a number of changes from the 2018 filing specifications. While the changes are relatively minor, as discussed in more detail below, employers should try to ensure that their software and/or vendors are aware of the changes and can accommodate the revised file specifications by the July 19, 2021, filing deadline.
