As we reported recently, the 2019 and 2020 reporting season for Employer Information (EEO-1) Reports began in earnest on June 1, 2021, when the Equal Employment Opportunity Commission (EEOC) enabled the “data file upload” filing option, which is used by the majority of large employers.
We also reported at the time that contrary to initial indications, the EEOC made revisions to the filing specifications that EEO-1 filers used the last time around for their 2018 reports. In retrospect, it should have been obvious that the tweaks to the specifications would also impact the filing procedures, and that is exactly what is happening.
Indeed, employers who have begun the process of filing their 2019 and 2020 EEO-1s have iterated that they are encountering significant delays in trying to log in and file their reports, even as the EEO-1 filing website itself has continued to evolve, with the addition of new user guides and support materials.
