NT Lakis, LLP, on behalf of the Center for Workplace Compliance (CWC) has filed written comments with U.S. Citizenship and Immigration Services (USCIS), a component agency of the Department of Homeland Security (DHS) that administers the I-9 verification process, in response to a request for public input concerning whether the temporary policy put in place by USCIS in March 2020 that allows remote documentation examination of I-9 forms should be made permanent.
Our comments, relying on the firsthand accounts voiced by employers about their experiences reviewing Form I-9 documentation remotely since the policy was instituted in response to the COVID-19 pandemic, echo our members’ strong support to make this option permanent in light of a collective increase in fully remote positions. At the same time, we urge USCIS to remove the policy’s current requirement that employers conduct an in-person reverification of the I-9 documents within three days after an employee physically returns to the workplace, arguing that this requirement is both unnecessary in light of today’s technology and overly burdensome.
