Almost any non-compete agreement would become illegal under a sweeping rule being considered by the Federal Trade Commission (FTC).
The proposed rule would categorically ban virtually any employer, regardless of size, from requiring non-compete clauses with any of its employees, regardless of the person’s earnings or job function. The far-reaching proposal also would apply to independent contractors working for an employer.
In addition to banning any new non-competes, the proposed rule would require employers to rescind existing non-compete agreements and actively inform individuals subject to such agreements that they are no longer in effect.
