With the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) effectively in a “holding pattern” until a new director is named, we thought it would be useful to look back over former Director Patricia Shiu’s “full-scale, aggressive enforcement” strategy in comparison to the agency’s enforcement strategy during the previous Republican administration.
Using OFCCP’s own published enforcement data, NT Lakis attorneys and non-attorney professionals have compared the reported audits, violations, and monetary settlements under former Director Shiu’s “active case enforcement” (ACE) directive to enforcement under the “active case management” (ACM) directive used by the previous OFCCP director, Charles James.
