NT Lakis, on behalf of the Center for Workplace Compliance (CWC), has filed written comments with the White House Office of Management and Budget (OMB) asking that agency to instruct the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) to make two minor revisions to OFCCP’s proposed new scheduling letter for federal construction contractors that will lessen the burden on both contractors and OFCCP.
Specifically, the comments recommend that OMB instruct OFCCP to modify the proposed Letter and its Itemized Listing: (1) to allow a scheduled contractor to provide examples in lieu of all of its communications with labor unions and community organizations as a means of demonstrating compliance; and (2) to clarify that a contractor can provide OFCCP its data and documents in the format in which the contractor maintains the data. As our letter notes, each of these minor modifications would result in a less burdensome, but equally effective alternative for both construction contractors and the agency.
