As COVID-19 vaccinations become more available, and the eligible population for receiving vaccinations expands, many employers are wrestling with the question of whether they should require their employees to be vaccinated as a condition of remaining in, or returning to, the workplace, and whether in fact it is legal to do so. Still other employers have made a conscious decision to forego a mandated approach, and instead are encouraging employees to get vaccinated, perhaps by offering incentives.
Although voluntary programs are much less likely to raise potential legal risks, neither of these approaches is without some risk. Accordingly, we thought it would be helpful to employers considering COVID-19 vaccination options to identify some of the principal legal issues that might arise, as well as offer some practical pointers that may lessen potential liability.
