The Equal Employment Opportunity Commission (EEOC) has finalized new rules governing the process under which the agency issues so-called guidance documents. The rules are in response to an Executive Order (E.O. 13891) issued by President Trump last year requiring most federal agencies (1) to establish a searchable, indexed database accessible to the public that contains or links to all “guidance” documents that are in effect from that agency, and (2) to finalize or amend existing regulations that set forth a process for issuing guidance documents.
