As we reported recently, the 2019 and 2020 reporting season for Employer Information (EEO-1) Reports was extended by the Equal Employment Opportunity Commission (EEOC) to August 23, 2021, due in part to unexpected delays in filing that many companies have encountered, and a backlog of support requests that have been submitted by filers to the contractor retained by the EEOC to collect the EEO-1 data.

In addition to filing delays, several employers have now reported that they are encountering filing errors in the reports themselves. As discussed in more detail below, one of the more significant issues that has arisen is an employer’s consolidated report not displaying headcounts for establishments with fewer than 50 employees contained in “Type 6” Reports. Accordingly, we recommend that employers that have successfully filed their 2019 and/or 2020 EEO-1s should double check their EEO-1 filings to ensure their consolidated report reflects the headcount uploaded into the EEO-1 filing system.

We have conferred with senior officials at the EEOC about the filing errors, and they advise us that they are investigating.
