As a reminder, a new law enacted by Congress in 2019 that prohibits federal contractors from asking job applicants about their criminal history on employment applications went into effect on December 20, 2021. The federal agencies charged with issuing implementing regulations have yet to do so, however, even though the law provides that those regulations were to be promulgated by last April.

From a practical perspective, many if not most large employers have already developed “ban-the-box” policies given the proliferation of state and local ban-the-box laws and the desire to apply a uniform companywide policy. Nevertheless, companies subject to the federal contractor ban need to be aware that it is now in effect.
