The number of complaints filed by military service members under USERRA dipped slightly for fiscal year 2023 but are still near historic highs, data from the Labor Department’s Veterans’ Employment and Training Service (DOL-VETS) show. The Uniformed Services Employment and Reemployment Rights Act protects the employment and reemployment rights of employees who have been called to active military duty.
The enforcement statistics, which appear in DOL-VETS’ Fiscal Year 2023 USERRA Annual Report to Congress, indicate that the number of complaints decreased slightly following last year’s big increase. Military service members submitted 981 USERRA complaints to DOL-VETS in FY 2023, a 3% drop from the 1,009 complaints in FY 2022. The past two years have seen higher numbers than those reported for the previous six years.
CWC has updated the table of comparative USERRA enforcement statistics showing the total number of complaints and bases filed each year with DOL-VETS, along with a breakdown by basis of complaint allegation over the past ten years.
