This memo summarizes workplace-related regulatory priorities that the Biden Administration listed in its latest semi-annual regulatory agenda. This memo, as well as a chart prepared by our affiliated nonprofit membership association, the Center for Workplace Compliance (CWC), provide a user-friendly digest of regulatory developments that we are following. Notably, for the first time in several years, the agenda lists several new items from the Equal Employment Opportunity Commission (EEOC), which now has a Democratic majority for the first time since President Biden was elected. The agenda also indicates that the Office of Federal Contract Compliance Programs (OFCCP) has hit the pause button on several items that it listed previously. The memo also discusses items listed by the Wage and Hour Division (WHD); the National Labor Relations Board (NLRB); the Department of Homeland Security’s U.S. Citizenship and Immigration Services (USCIS); the Federal Acquisition Regulatory (FAR) Council; the Securities and Exchange Commission (SEC); the Department of Agriculture (USDA); and the Federal Trade Commission (FTC).
