Given its importance to many employers, we have been reporting periodically on the status of the H-1B visa program. H-1B visas are issued by the government to foreign workers in “specialty occupations” that require the theoretical and practical application of a body of highly specialized knowledge, most commonly in computing, science, math, and engineering fields.

Although the Trump Administration made several efforts to tighten the rules under which H-1B visas are issued, the program today remains largely intact, and the Biden Administration has not indicated any inclination to follow the path taken by the last administration.

The following memo summarizes recent developments involving the H-1B program since our last update in February 2021.
