Labor Department Seeks Input on FMLA Regulations and Paid Leave Programs

The U.S. Department of Labor (DOL) has published two separate “Requests for Information” (RFI), the first seeking public input on questions related to the availability and use of paid leave, and the second asking for feedback on the regulations implementing the Family and Medical Leave Act (FMLA).

The FMLA RFI has been on the Trump Administration’s regulatory agenda for some time, and information received will be used by DOL to determine whether and to what extent it should propose revising its FMLA regulations to better effectuate rights and obligations of both employees and employers. The paid leave RFI is a new initiative and DOL hopes feedback received will help it determine promising practices related to eligibility requirements, costs, and administrative models of existing programs.
