The law firm of Norton Rose Fulbright (NRF), LLP recently released its 14th annual litigation trends survey, reflecting the input of more than 350 in-house lawyers, the majority of whom are U.S.-based or represent U.S.-based organizations. NRF’s annual survey includes questions on a range of issues, such as what types of claims and disputes are of most concern to corporate counsel and how many lawsuits, arbitrations, and/or regulatory actions were filed against their companies.

The latest survey results show that over a quarter of businesses anticipate the volume of disputes to increase over the next year, and in-house counsel continue to cite employment and contracts litigation as main areas of concern. In addition, two-thirds of respondents reported feeling more exposed to cybersecurity data protection issues. Notably, respondents also reported less concern over regulatory disputes than in previous years.

We should note that NRF provides only a broad summary of the survey results, and the information provided in this latest survey is not as robust as it has been in past years. For example, NRF reports that class actions continue to be a top area of concern across all industries surveyed, but does not provide a breakdown of concerns over class actions by industry, making it difficult to discern how concerns over class actions are trending as a whole.
