Enforcement statistics published recently by the U.S. Department of Labor’s Veterans’ Employment and Training Service (DOL-VETS) show that the number of new complaints filed with the agency by military service members under the Uniformed Services Employment and Reemployment Rights Act (USERRA) for Fiscal Year (FY) 2018 dropped to a ten-year low of just 917 total filings. The stats are contained in DOL-VETS FY 2018 Annual Report to Congress, and are the most recent available.
Not surprisingly, the total number of administrative complaints resolved by DOL-VETS also decreased to its second lowest total in ten years. Indeed, the 980 complaints closed in FY 2018 is over 40% below the 1,675 resolutions recorded in FY 2011.

Table I covers the total number of complaints and bases filed each year with DOL-VETS along with a breakdown by basis of complaint allegation. Table II details the total numbers and types of annual complaint resolutions over the same period.
