New York City is the first jurisdiction in the country to ban pre-employment drug testing for marijuana use, with some limited exceptions. Under an ordinance passed by the City Council and not vetoed by Mayor Bill de Blasio before the May 9, 2019 deadline, covered employers will be prohibited from requiring a prospective employee “to submit to testing for the presence of any [marijuana] in his or her system as a condition of employment.”

The effective date of the ban is May 9, 2020, or one year after becoming law. The ban will apply to any employer operating in New York City with four or more employees.
