In a positive development for federal contractors, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has announced that it intends to seek approval, via a revised agency “directive,” to extend with some minor changes its functional affirmative action program (FAAP) process for several more years. OFCCP has submitted its revised FAAP Directive to the White House Office of Management and Budget (OMB) for approval as required under the federal Paperwork Reduction Act (PRA). OMB’s current approval expires in June, and requests for extensions are routinely granted for three years. This is the first – and welcome – indication from OFCCP Director Jenny Yang that she intends to maintain the FAAP option for qualifying federal contractors.

As discussed in more detail below, while the basic FAAP application and approval requirements would remain unchanged, under the revised directive OFCCP is proposing some minor changes to FAAP notification requirements in the name of increasing efficiency. In addition, OFCCP is considering whether to use its new AAP-VI Contractor Portal as the means for contractors to submit FAAP Addendum updates such as modifications to functional units.
