The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has released a new directive reaffirming the agency’s commitment to a number of previously announced policy and enforcement initiatives and establishing a framework for escalating federal contractor questions to OFCCP’s Director of Division of Policy and Program Development and Director of Enforcement.
Directive 2021-02, Certainty in OFCCP Policies and Practices, is intended to “reaffirm OFCCP’s commitment to a number of certainty initiatives and principles, and establish a process to facilitate the continued provision of clarity and certainty in OFCCP policies and practices.” Among other things, the directive reaffirms and incorporates by reference the agency’s 2018 contractor “Bill of Rights,” which is attached to the new directive for emphasis.
