CWC presented an update on major financial settlements that have been announced by the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) since November 2022. A quarter of the way into fiscal year 2023 (October 1, 2022 – September 30, 2023), OFCCP has posted six new financial settlements totaling $3.13 million in financial relief awarded to alleged victims of discrimination. In contrast, OFCCP posted only one new financial settlement during the first quarter of FY 2022. All of the FY 2023 financial settlements posted are standard conciliation agreements (CAs) alleging violations under Executive Order 11246. Two allege hiring discrimination, two allege unlawful termination, one alleges compensation discrimination, and one alleges both hiring and compensation discrimination. Five of the settlements originated from a scheduled compliance evaluation, and one was based on a complaint investigation. In addition to these six CAs, OFCCP also announced a consent decree under which the contractor agreed to provide requested data.
