According to a new batch of financial settlements made public by the U.S. Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) since our last update in May, the agency thus far has collected over $10.5 million in back pay and interest for over 13,000 individuals since the beginning of its current Fiscal Year (FY) 2020 (October 1, 2019 – September 30, 2020). Of particular note, over $7.3 million of that total has been generated from Early Resolution Procedures (ERP) settlements, a compliance option that OFCCP launched in late 2018 designed to encourage and formalize “enterprise-wide” settlements by offering a five-year moratorium on OFCCP audits of establishments included in the ERP settlement.

Of the ten financial settlements (formally known as Conciliation Agreements, or CAs) posted since our last update, three of which include ERP settlements, seven were for alleged hiring discrimination violations, one for compensation discrimination violations, one for both hiring and compensation discrimination violations, and one for disability and veteran discrimination violations. All ten of these settlements can be accessed in OFCCP’s online Freedom of Information Act (FOIA) Library.
