Consistent with inflationary adjustments to federal contract coverage thresholds set by the Federal Acquisition Regulation (FAR) Council, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has updated its online “infographic” outlining the contract value and employee headcount thresholds that trigger coverage under the agencys nondiscrimination and affirmative action requirements.

Under legislation enacted by Congress in 2005, the FAR Council is directed to make inflationary adjustments of “acquisition-related dollar thresholds” every five years. The 2005 law applies to federal statutes that contain dollar coverage thresholds, including Section 503 of the Rehabilitation Act and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).

OFCCP’s new jurisdictional infographic already reflected the FAR Councils increase in the contract value threshold triggering coverage under Section 503, from $10,000 to $15,000. The FAR Council has now revised the contract coverage threshold under VEVRAA, from $100,000 to $150,000. As a result, OFCCP has updated its infographic to reflect the revised coverage threshold.

A senior OFCCP policy official has confirmed with NT Lakis that the agency will apply the revised FAR contract value thresholds “across the board,” including to requirements under both the equal opportunity clause and affirmative action program provisions.
