Last week, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) released three important new directives aimed at further improving the efficiency of OFCCP’s compliance evaluation procedures. The first of these directives, entitled “Efficiency in Compliance Evaluations,” is analyzed in this memorandum. The other two directives, one providing details on the agency’s new Ombuds program and the other establishing a “prereferral” mediation program, will each be analyzed in forthcoming memos.

OFCCP directives are internal documents issued by the OFCCP Director that are designed to provide guidance to OFCCP enforcement personnel on current agency policy and compliance evaluation procedures. New Directive 2020-02, Efficiency in Compliance Evaluations, outlines a number of operational initiatives that will allow federal contractors the opportunity to obtain a status update on an aging audit. The new directive is intended to facilitate the goal of OFCCP Director Craig Leen to shorten the duration of agency compliance evaluations.
