President Donald Trump, with minimal delay, has nominated Judge Amy Coney Barrett to fill the U.S. Supreme Court vacancy created by the recent passing of long-time Justice Ruth Bader Ginsburg. Judge Barrett most recently has served as a judge on the U.S. Court of Appeals for the Seventh Circuit following her U.S. Senate confirmation to that position in 2017.
Although we cannot predict whether her nomination to the Supreme Court will be approved by the Senate before the November elections, we nevertheless thought it might be of interest to CWC members to provide a brief summary of employment-related opinions she has written while an appeals court judge in the event she is confirmed. We leave it up to the reader to discern whether these cases provide any meaningful insight as to how Judge Barrett might rule if she is elevated to the High Court.
