The European Union’s (EU) restrictions on the transfer of personal data, including employee data, to the United States continue to raise challenging issues for U.S. companies with affiliates in the EU.
While the U.S. and the EU agreed last year on a protocol — the so-called Privacy Shield — to enable U.S. companies to obtain data from partners in the EU without running afoul of EU law, that agreement is up for review and possible amendment in the near future. Meanwhile, the EU administrative agency that provides advice on data protection has issued new guidance on how the EU’s data protection laws affect the use of personal data in the workplace.
Accordingly, NT Lakis staff has prepared an update on the status of the EU’s data protection efforts, including a summary of the new guidance regarding the processing of data at work.
