As we approach next week’s midterm elections, we thought it might be helpful to provide an updated state-by-state summary of voter leave entitlement laws. While there is no federal law that grants employees the right to take time off to vote, there are now at least 30 states (as well as Puerto Rico) that provide some level of protected leave to allow employees the opportunity to vote.

In light of these protections, we prepared a summary of each relevant state law. Employers are also advised to check the law of the particular states in which they have interests, to ensure compliance.
