Recently published enforcement statistics from the U.S. Department of Labor’s Veterans’ Employment and Training Service (DOL-VETS) show that the number of new complaints filed with the agency by military service members under the Uniformed Services Employment and Reemployment Rights Act (USERRA) for Fiscal Year (FY) 2019 rebounded slightly to a total of 950 following the previous year’s 10-year low of just 917 complaints. In addition, DOL-VETS reports that 940 administrative complaints were resolved in FY 2019. The latest USERRA enforcement numbers are contained in the DOL-VETS FY 2019 Annual Report to Congress.
To put the latest data into perspective, we have prepared two tables showing comparative statistics over the last 10 years. Table I covers the total number of complaints and bases filed each year with DOL-VETS along with a breakdown by basis of complaint allegation. Table II details the total numbers and types of annual complaint resolutions over the same period.
