The 2018 reporting season for Employer Information (EEO-1) Reports officially began this week, with the launch of the 2018 EEO-1 Survey website. Covered employers should have received (or will be receiving) their company’s annual Notification Letter from the Equal Employment Opportunity Commission (EEOC), which will contain a temporary password to log in to the EEO-1 filing system. Completed EEO-1s are due by May 31, 2019.
As of this writing, the EEOC’s online portal is accepting only the “old” EEO-1, referred to as “component 1,” and the EEOC has not yet provided any further information as to whether EEO-1 filers will also be required to submit summary compensation and hours worked data, which are referred to as EEO-1 “component 2.”
On March 4, 2019, a federal trial court in Washington, DC ruled that the Trump Administration’s rescission of major changes to the EEO-1 made during the Obama Administration – the “component 2” data – was illegal, and ordered the EEOC to reinstate the Obama Administration’s compensation and hours worked data requirements. The judge in that case has now given the EEOC until April 3, 2019, to advise when and how it plans to collect the component 2 data.
For now, covered employers are only required to complete and submit the old EEO-1 (the “component 1” data) by the May 31, 2019 filing deadline. The EEOC has also confirmed that the filing requirements and filing methods that were used to submit the 2017 EEO-1 data remain unchanged.
