The Center for Workplace Compliance (CWC) filed written comments with the Equal Employment Opportunity Commission (EEOC) on its proposed 2023-2027 Strategic Enforcement Plan. CWC’s comment letter generally supports the agency’s draft SEP, which is similar in form and substance to the outgoing five-year SEP. At the same time, CWC urges the EEOC to prioritize the development of guidance under the newly enacted Pregnant Workers Fairness Act, noting that some of the law’s provisions are vague. CWC also urges the EEOC to keep its focus on enforcement related to unlawful conduct and avoid any tendency to challenge employment practices that are not unlawful.
