The U.S. Department of Labor (DOL) reports that the number of administrative complaints it closed in fiscal year 2022 alleging overtime and minimum wage violations under the Fair Labor Standards Act (FLSA) declined for the 10th straight year. Annual FLSA enforcement data show that DOL closed only 13,853 wage and hour complaints in FY 2022, compared to 24,511 closed in FY 2013. The number of overtime cases closed in FY 2022 dropped by 17.5%, although the number of closed minimum wage cases actually increased by 9.1%. Total closed cases nevertheless declined by 4.1%. The downward trend has continued despite an expectation that FLSA enforcement would increase dramatically under the Biden Administration.
