Employers will have new reverification obligations and heightened compliance risks under an E-Verify expansion implemented by DHS. The E-Verify Status Change Report now includes invalidated Employment Authorization Documents (EADs) issued to individuals granted Temporary Protected Status (TPS), TPS applicants, asylum applicants with pending asylum applications, and adjustment of status for permanent residence applicants. Previously, the report identified only specified parolee EADs.

The Status Change Report, which DHS updates every two weeks, identifies employees whose EADs appeared valid when they completed the employment verification process but which DHS later invalidated. Employers that rely solely on the document’s expiration date risk missing reverification obligations and potentially continuing an employee’s employment after his or her work authorization has ended. Employers enrolled in E-Verify should routinely review the Status Change Report, particularly if they employ workers with EADs based on Temporary Protected Status, pending asylum applications, or pending adjustment of status applications.
