Included in the massive spending bill recently approved by Congress was a provision amending the Fair Labor Standards Act (FLSA) to prohibit employers from keeping tips received by their employees for any purposes. The amendment makes clear that a proposed FLSA regulation published by the Department of Labor (DOL) a few months ago could not be interpreted to allow employers to retain any portion of employees’ tips.
